THIS SWEEPSTAKES IS INTENDED FOR PLAY IN THE UNITED STATES ONLY AND IS GOVERNED BY THE LAWS OF THE UNITED STATES. DO NOT ENTER IF YOU ARE NOT AN ELIGIBLE INDIVIDUAL AND LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY.
NO PURCHASE, PAYMENT OR SALES PRESENTATION NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1) Eligibility: The "Midwest Fiat 500" Sweepstakes ("Sweepstakes") is open to individuals who are legal residents of IL, MO, and WI who are 18 years of age or older and have a valid driver's license at the time of entry and the time prize is awarded. Void outside of IL, MO and WI and where prohibited. Employees of Chrysler Group LLC ("Sponsor") and its affiliated companies, subsidiaries, distributors, Dodge/Chrysler/Jeep®/Ram/Fiat dealers and any advertising and promotion agencies associated with this Sweepstakes in any way, and members of the immediate families (spouse, siblings, parents, children and their respective spouses) or households of each such employee, are not eligible.
2) How To Enter: (1) To enter visit a participating Fiat dealership during normal business hours between September 3, 2011 and December 31, 2011 (the "Promotion Period") and follow the instructions to enter by completing the entry form. No sales presentation necessary to enter. (2) You may also enter through representatives Fiat booths at select events in IL, MO, and WI throughout the Promotion Period. You will receive one entry into the Grand Prize drawing for each entry submitted. Limit one (1) entry per person/per day. For purposes of this Sweepstakes, a "day" is the 24 hours between 12:00 am CT and 11:59 pm CT. Entries made by the same person under multiple identities or through the use of any agent or other device or artifice to enter multiple times, will be deemed invalid. Only fully completed entry forms are eligible. No mechanical reproductions of entries allowed. Sponsor is not responsible for errors with respect to completion of the entry form. Sponsor is not responsible for lost, late, illegible, misdirected, mutilated, or incomplete entries.
3) Grand Prize Drawing/Winner Notification: One (1) Grand Prize winner will be selected in a random drawing from all eligible entries received throughout the Promotion Period on or about January 9, 2012. Potential Winner will be notified by email and/or phone on or about January 10, 2012. Potential winners are subject to verification, including verification of age. In the event that a potential winner is disqualified for any reason, prize may be forfeited. Sponsor reserves the right to award the prize to an alternate entrant who will also be selected randomly, even if the disqualified Potential Winner's name may have been publicly announced. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants. Potential winners are subject to verification, including verification of age. In the event that a potential winner is disqualified for any reason, prize may be forfeited.
4) Prizes/Odds: Grand Prize (1): a cash allowance of up to $15,500 towards the purchase of one new Fiat 500. ARV: $15,500. The allowance may be applied towards the purchase of a single Fiat 500 with a manufacturer's suggested retail price (MSRP) of $15,500 or less (including factory options). If the MSRP (including factory options) of the selected vehicle is less than $15,500, the difference will not be awarded in cash and winner will forfeit the unused amount of the allowance. The allowance may not be redeemed for cash. Winner may select a vehicle with an MSRP (including factory options) exceeding $15,500 but will be responsible for all costs, fees, expenses, and taxes in excess of $15,500. The odds of winning a Grand Prize depend on the total number of eligible entries received. Vehicles subject to availability. Grand Prize Winner must present a valid U.S. driver's license and proof of insurance to take delivery of vehicle; failure to show same may result in prize forfeiture and selection of an alternate winner. Winner will be responsible for all title, license, insurance and registration fees required in claiming the vehicle, applicable sales tax, if any, as well as all other expenses relating to the receipt and use of Grand Prize vehicle, including any travel and transportation costs associated with collecting the vehicle. All other costs not specifically stated herein as being awarded are the responsibility of the Winner. Winner will be provided instructions to obtain his/her Grand Prize vehicle at a dealership to be determined by Sponsor. Winner must take delivery of vehicle within 30 days of notification that dealership has received vehicle. Delivery of a Grand Prize vehicle subject to production and delivery schedules. Prizes are not transferable. Sponsor reserves the right to award a prize of equal or greater value if prize becomes unavailable. All federal, state and local income taxes are the sole responsibility of the winner. Winner will be issued an IRS 1099 form for the value of the prize. Unclaimed prize will not be awarded. By participating, entrants agree to these Official Rules, which are final and binding in all respects.
5) General Terms: Administrator is responsible for conducting this Sweepstakes and Administrator's decisions on all matters relating to this Sweepstakes are final. Potential winners will be required to execute and return an Affidavit of Eligibility and a Liability/Publicity Release (except where requiring a publicity release is prohibited) within ten (10) days of notification. Non-compliance within this time period, or the return of winner's prize notification as undeliverable, may result in disqualification and prize may not be awarded. Upon prize forfeiture, no compensation will be given.
6) Release: By participating, entrants agree to abide by and be bound by the official rules and instructions and the decisions of the administrator. Acceptance of any prize constitutes permission to use winner's name, photograph, likeness, biographical information and/or statements for advertising or promotion on behalf of Sponsor in all media worldwide without limitation, notice or further compensation, except where such requirement is prohibited by law. By participation in the Sweepstakes and acceptance of any prize, entrants and Winner agrees to release and hold harmless Sponsor, its dealers, affiliated companies and subsidiaries, advertising and promotional agencies and any and all other companies associated with this program, including but not limited to Administrator, and their respective officers, directors and employees, from any and all liability, for loss, harm, damage, injury, cost, or expense whatsoever including without limitation, property damage, personal injury and/or death, which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity, and any travel related thereto, and for any claims based on publicity rights, defamation or invasion of privacy. By participating, entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and/or consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR
INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of Michigan, and all claims must be resolved in the federal or state courts of Oakland County, Michigan.
7) Winners List: For the names of the winners, send a stamped, self-addressed envelope to: "Midwest Fiat 500" Sweepstakes Winners List, 4040 MacArthur Blvd, Suite 310, Newport Beach, CA 92660. All requests must be received by January 31, 2012. Winners lists will be sent once Grand Prize winner has been verified.
